DEVELOPER LISTING AGREEMENT

1. Introduction

This Developer Listing Agreement (“Agreement”) governs the relationship between PattayaLink (“Platform,” “we,” “us”) and the Developer (“Developer,” “you”) listing property projects on PattayaLink.com.

By submitting a project for listing, the Developer agrees to comply with these terms.


2. Purpose of the Platform

PattayaLink operates as an independent online marketplace specializing in:

  • Pre-Launch property projects

  • Off-Plan developments

  • Early Bird investment opportunities

The Platform provides marketing exposure, structured project presentation, and optional online booking facilitation.

PattayaLink is not:

  • A property developer

  • A financial advisor

  • A legal advisor

  • A joint venture partner


3. Eligibility & Representation

By listing a project, the Developer confirms:

  • The company is legally registered and authorized to operate in Thailand.

  • The Developer has full authority to market and sell the listed project.

  • All submitted information is accurate and not misleading.

  • The Developer has the legal right to authorize PattayaLink to publish project materials.

The Developer shall immediately notify PattayaLink of any material changes.


4. Developer Verification Process

To receive “Developer Verified” status, the Developer agrees to provide:

  • Company registration documentation

  • Authorized representative information

  • Project details and relevant approvals (where applicable)

  • Confirmation of direct listing rights

Verification by PattayaLink:

  • Is based on document review at the time of submission.

  • Does not constitute a guarantee of project performance.

  • May be revoked if inaccurate information is discovered.


5. Project Information Accuracy

The Developer is solely responsible for:

  • Pricing accuracy

  • Unit availability

  • Payment terms

  • Construction timelines

  • Project specifications

  • Marketing claims

PattayaLink may remove or suspend listings containing:

  • False information

  • Misleading claims

  • Unverified guarantees

  • Unrealistic return promises


6. Online Booking & Reservation

If the Developer participates in online booking:

  • All booking confirmations are subject to Developer approval.

  • Reservation fees and refund policies are governed by the Developer’s contract.

  • PattayaLink does not hold responsibility for refund disputes.

The Developer must:

  • Respond promptly to booking inquiries.

  • Confirm or reject reservations within agreed timelines.

  • Honor confirmed reservation commitments.


7. Marketing Rights

The Developer grants PattayaLink a non-exclusive right to:

  • Publish project information

  • Display images, floor plans, and marketing materials

  • Promote listings through digital channels

  • Feature projects in Early Bird or promotional sections

All intellectual property remains the property of the Developer.


8. Fees & Commission (If Applicable)

Where applicable, the Developer agrees to:

  • Pay agreed listing fees or commissions.

  • Comply with payment terms stated in separate commercial agreement.

  • Provide accurate sales reporting for commission calculation.

Failure to comply may result in listing suspension.


9. Limitation of Platform Liability

PattayaLink shall not be liable for:

  • Project construction delays

  • Market downturns

  • Buyer disputes

  • Refund disagreements

  • Developer insolvency

  • Regulatory changes

The Developer agrees to indemnify PattayaLink against claims arising from:

  • False information

  • Contract disputes

  • Regulatory violations

  • Misrepresentation


10. Ethical Standards

The Developer agrees not to:

  • Advertise guaranteed returns without legal substantiation.

  • Misrepresent rental yields.

  • Publish misleading promotions.

  • Circumvent platform booking mechanisms (if contracted).

PattayaLink reserves the right to remove listings that damage platform credibility.


11. Termination

PattayaLink may terminate or suspend listings if:

  • Developer breaches agreement terms.

  • Information is proven inaccurate.

  • Payments are overdue.

  • Project becomes legally non-compliant.

Termination does not relieve the Developer from outstanding obligations.


12. Confidentiality

Any confidential information exchanged between PattayaLink and the Developer shall not be disclosed to third parties without consent, except as required by law.


13. Governing Law

This Agreement shall be governed by the laws of Thailand.

Any disputes shall be subject to Thai jurisdiction.
